Council Focus Area(s):] NUMBER, UM, ITEM NUMBER 14, A REQUEST WAS MADE BY COUNCIL MEMBER ORLANDO WITH SOME QUESTIONS, COUNCIL MEMBER ORLANDO MAYOR HAS THAT TAKEN CARE OF TODAY. THANK YOU. OKAY. [15. Resolution No. 5596 Approving the Intergovernmental Agreement Between the Maricopa County Community College District, on behalf of Chandler-Gilbert Community College, and the City of Chandler for a shared Student Services Internship Coordinator Move City Council pass and adopt Resolution No. 5596 approving the Intergovernmental Agreement between the Maricopa County Community College District, on behalf of Chandler-Gilbert Community College, and the City of Chandler for a shared Student Services Internship Coordinator. Council Focus Area(s):] NEXT ITEM IS ITEM NUMBER 15. UH, COUNCIL MEMBER HARRIS HAD SOME COMMENTS. UM, YEAH. MR. MAYOR, COUNCILLOR HARRIS. UM, IF YOU HAD A COMMENT OR A QUESTION ABOUT THE SIDE OF THEM, I THINK YOU MAY BE WANTING TO MAKE A COMMENT ABOUT, UH, THIS NEW PARTNERSHIP WITH CHANDLER-GILBERT COMMUNITY COLLEGE. WE CERTAINLY HAVE STAFF AVAILABLE IF YOU'D LIKE TO GIVE A PRESENTATION AS WELL. I JUST WANTED THEM TO TALK ABOUT THE PARTNERSHIP, BECAUSE I THINK THIS IS ANOTHER WAY OF HOW WE CONTINUE TO DO WHAT WE DO BETTER. SURE. I'LL HAVE RAELYNN NIELSEN OR HUMAN RESOURCES DIRECTOR, KIND OF A BRIEF OVERVIEW, GOOD EVENING, MAYOR AND COUNCIL. I'M NEVER VERY EXCITED TO COME UP HERE, BUT I'M SO EXCITED TO COME UP HERE TODAY ABOUT THIS AGENDA ITEM. UM, IT'S SOMETHING THAT WE'VE BEEN WORKING ON FOR SEVERAL MONTHS, UM, A PARTNERSHIP WITH CHANDLER GILBERT COMMUNITY COLLEGE. SO WHAT THIS WILL DO IS WE WILL HAVE A SHARED EMPLOYEE 50%, UM, FROM THE COLLEGE 50% FROM THE CITY, THEY WILL BE HOUSED IN HUMAN RESOURCES. AND REALLY OUR PLAN IS TO DEVELOP AN INTERNSHIP PROGRAM SO THAT WE HAVE A PATHWAY INTO SOME OF OUR CAREERS AND A GOOD PARTNERSHIP WITH CHANDLER GILBERT. THEY ALSO HAVE AGREED TO BE OUR CONDUIT WITH OTHER COMMUNITY COLLEGES. SO RIGHT NOW, EXCUSE ME, WE ALREADY PARTNER WITH GATEWAY, UM, IN OUR WATER AND WASTEWATER AREA. SO THEY WILL HELP US, UM, WITH SOME OF THOSE OTHER PARTNERSHIPS, UM, THROUGHOUT THE, UM, VALLEY. SO WE'RE VERY EXCITED. UM, AND IN ANTICIPATION OF YOU APPROVING THIS ON THURSDAY, I ALREADY HAVE A MEETING SCHEDULED ON MONDAY, SO WE CAN WORK ON THE RECRUITMENT TO GET THAT COORDINATOR MOVING. THANK YOU. UM, THE REASON WHY I WON, I WANTED TO CONTINUE TO SHARE WITH EVERYONE HOW THE CITY CONTINUES TO BUILD RELATIONSHIPS, TO CREATE THAT PIPELINE FROM, YOU KNOW, HIGH SCHOOL AND HAVING OUR RESIDENTS AND OUR STUDENTS STAY HERE IN THE CITY OF CHANDLER, WHICH IS WHY WE'VE WORKED VERY HARD TO BUILD RELATIONSHIP WITH THE UNIVERSITY OF ARIZONA CHANDLER GILBERT COMMUNITY COLLEGE, AND ALSO MAKING SURE THAT WE'RE BUILDING GREAT STRIDES WITH ARIZONA STATE UNIVERSITY, BECAUSE WE WANT PEOPLE TO BE ABLE TO COME TO SCHOOL HERE AND BE ABLE TO FIND A CAREER HERE. AND THIS IS JUST ANOTHER EXAMPLE OF HOW WE'RE OPENING UP THOSE PIPELINES. AND THAT IS JUST KUDOS TO MAYOR COUNCIL VISION AND YOU ALL'S VISION, HELPING US MAKE SURE THAT WE HAVE AN ESTABLISHED PARTNERSHIP, UH, WITH OUR, WITH OUR SCHOOLS AND BUILDING ON OUR, OUR ANCHOR INSTITUTIONS TO MAKE SURE THAT OUR STUDENTS DO HAVE A PLACE WHERE THEY CAN SAY, I CAN GO TO SCHOOL THERE. I CAN WORK THERE AND I CAN HAVE A GOOD LIFE THERE. SO THANK YOU AGAIN FOR, FOR THIS, UM, AWESOME, AWESOME ACHIEVEMENT THAT YOU GUYS HAVE HELPED MAKE HAPPEN HERE. WE'RE EXCITED. ANY ADDITIONAL QUESTIONS OR COMMENTS FROM COUNCIL VESPER? THANK YOU, MAYOR RAELYNN, UM, KUDOS TO YOU, TO THE CITY MANAGER, TO STAFF FOR DOING THIS. I'M A HUGE FAN OF VOCATIONAL EDUCATION AND OPPORTUNITIES FOR YOUNG PEOPLE. AND, UM, IT, IT, IT'S, IT'S JUST ABOUT TIME. SO THANK YOU VERY MUCH. I APPRECIATE IT BECAUSE REMEMBER L AS YOU KNOW, FROM DAY ONE, RIGHT, WE WANTED TO HIT THE GROUND RUNNING WITH THIS PROJECT AND KEEP PUSHING THROUGH BECAUSE HIGHER EDUCATION IS THE KEY TO KEEPING PEOPLE OUT OF POVERTY. SO THIS IS ANOTHER WAY THAT WE ARE TELLING THE PEOPLE OF CHANDLER THAT WE CAN SUPPORT THAT INTO BRINGING THEM TO THE NEXT LEVEL OF ECONOMIC DEVELOPMENT AND MAKING SURE THAT THEIR LIVES WILL NEVER BE THE SAME ONCE THEY'RE INTO A PROGRAM LIKE THIS. I CAN'T WAIT TO HAVE THESE STUDENTS STARTED TO COME HERE AS AN INTERN AND SEEING WHAT WE DO AND GETTING EXCITED ABOUT THE CITY THAT THEY LIVE ON. SO THANK YOU AGAIN FOR DOING THIS. AND I KNOW WE'VE HAD, WE USED TO HAVE A GOOD INTERN PROGRAM AND PEOPLE LIKE NIKKI TAPPIA AND HEATHER FROM PITTSBURGH, AND REALLY A HANDFUL OF GREAT EMPLOYEES THAT ARE STILL WITH US CAME THROUGH THIS PROGRAM. I'M VERY EXCITED TO SEE A NEW EDITION RENDITION, UH, UPDATED THAT WILL, UH, REALLY BRING US SOME TOP QUALITY FOLKS THAT, UH, WE'LL FIND A LIFE AND A CAREER WORKING FOR THE CITY OF CHANDLER AND GIVING BACK TO THEIR COMMUNITY. SO THANK YOU AND CITY MANAGER AND ALL WHO WERE INVOLVED WITH US, [00:30:03] HOPEFULLY YOU GRABBED THE RESUMES OF THOSE TWO CHANDLER HIGH STUDENTS THAT WERE UP HERE EARLIER. I ALWAYS INSANE AND WE'RE HIRING, SO, OKAY. THANK YOU. VERY LYNN. [24. Final Adoption of Ordinance No. 5018 Levying upon the Assessed Valuation of the Property within the City of Chandler, Arizona, Subject to Taxation, a Certain Sum upon Each One Hundred Dollars ($100) of Assessed Valuation Sufficient to Raise the Amount Estimated to be Required in the Annual Budget, Less the Amount to be Received from Other Sources of Revenue; Providing Funds for Various Bond Redemptions, for the Purpose of Paying Interest Upon Bonded Indebtedness and Providing Funds for General Municipal Expenses, all for the Fiscal Year Ending the 30th Day of June, 2023 Move City Council pass and adopt Ordinance No. 5018, levying upon the assessed valuation of the property within the City of Chandler, Arizona, subject to taxation, a certain sum upon each one hundred dollars ($100) of assessed valuation sufficient to raise the amount estimated to be required in the annual budget, less the amount to be received from other sources of revenue; providing funds for various bond redemptions, for the purpose of paying interest upon bonded indebtedness and providing funds for general municipal expenses, all for the Fiscal Year ending the 30th day of June, 2023. Council Focus Area(s):] NEXT ITEM I CALLED IN WAS BY ME. I JUST HAD SOME COMMENTS ON ITEM NUMBER 24. UM, THIS IS THE LAST OF THE, UH, THE FINANCIAL PACKET THAT WE STARTED A PROCESS WITH PUBLIC MEETINGS WITH COUNCIL MEETINGS BACK IN, UH, REALLY SEPTEMBER, OCTOBER, AND, UH, WE'VE PASSED A BUDGET AND THIS IS THE LAST PART OF THAT, WHICH IS THE, UH, PROPERTY TAX. AND I'M VERY PLEASED COUNCIL THAT, UH, WE'RE WE'RE WELL OFF. I MEAN, IN TERMS OF THAT, OUR COFFERS ARE, UH, WELL-POSITIONED IN THE CITY, BUT WE'RE ABLE TO FOR THE SEVENTH YEAR IN A ROW TO LOWER PROPERTY TAX RATES. AND, UM, IT'S, IT'S GOOD TO BE ABLE TO DO THAT AND TO GIVE MONEY BACK TO THE COMMUNITY, IT'S THEIR COMMUNITY, IT'S THEIR TAX DOLLARS. AND, UM, COUNCIL WAS VERY PLEASED TO BE PART OF THIS. SO, UM, THANK YOU FOR THIS RECOMMENDATION FROM OUR STAFF. AND, UH, ONE OTHER COMMENT ON THIS IS YOUR PROPERTY TAX. UH, EVEN THOUGH WE'RE LOWING LOWERING THE CITY'S RATE BY 1 CENT, ONLY 10% OF YOUR OVERALL PROPERTY TAX GOES INTO THE CITY COPPERS. THE LARGEST PORTION IS THROUGH THE LOCAL HIGH SCHOOLS AND COMMUNITY COLLEGE. AND, UH, WE'LL SEE WHAT THEY DO WITH THEIR SHARE OF THE SAME. SO ADDITIONAL COMMENTS FROM COUNCIL, I JUST WANTED TO ADD MED. THIS IS WHAT IT'S ALL ABOUT. UM, LAUREN AND PROPERTY TAXES AND MAKING SURE WE USE PAYERS DOLLARS EFFECTIVELY. AND THIS IS ANOTHER WAY OF HOW WE CAN, UM, HOW WE USE OUR TAX PAYER DOLLARS TO GIVE BACK TO THEM WHILE THEY'RE GIVING, UM, TO, TO MAKE SURE THE CITY IS TAKEN CARE OF AND KUDOS TO DAWN'S TEAM FOR DOING A GREAT JOB ON THAT AS WELL. VERY GOOD. [27. Ordinance No. 5020 Amending the Code of the City of Chandler, Chapter 6, Emergency Management, Section 6-3 Powers and Duties, Subsection 6-3.2 Relating to the Mayor's Authority to Declare an Emergency Move City Council introduce and tentatively adopt Ordinance No. 5020, amending the Code of the City of Chandler, Chapter 6, Emergency Management, Section 6-3 Powers and Duties, Subsection 6-3.2 relating to the Mayor's authority to declare an emergency. Council Focus Area(s):] OUR NEXT ITEM, UH, CALLED IN FOR AS A BRIEFING ON ITEM NUMBER 27 BY COUNCIL MEMBER ORLANDO AND CHANGING SOME AMENDING CITY CODE COUNCIL MEMBER ORLANDO. OR DO I TURN THIS OVER TO CITY MANAGER? UH, NO, I, YEAH, JUST WANTED TO, I KNOW COUNCIL MEMBER, UM, YOU AND I SPOKE ABOUT THIS LAST WEEK AND HE SAID HE WAS GOING TO HAVE A COUPLE OF BRIEFINGS. I JUST WANTED TO HEAR WHAT HIS THOUGHTS WERE ON THIS COUNCIL MEMBER ORLANDO. I THINK JOSH IS GOING TO GIVE A RUNDOWN OF THE, UH, OF THE ORDINANCE CHANGE REAL QUICK. AND THEN I'LL, I WILL SAY A FEW WORDS ABOUT, YEP, MAN. HEY, MAYBE THAT'S A DISCONNECT. THANKS. APPRECIATE IT. YOU BET. IF I MAY MARROW I'LL JUMP IN. UM, SO THE, THE ORDINANCE AS PROPOSED BY COUNCIL MEMBER STEWART UNDER OUR CURRENT CODE, UH, THE MAYOR IS AUTHORIZED TO DECLARE AN EMERGENCY BY PROCLAMATION THAT'S UNDER STATE LAW, AS WELL AS OUR CURRENT CODE. THE CURRENT CODE ALLOWS THE MEREDITH TO PROCLAIM OR DECLARE THAT AN EMERGENCY EXISTS AND THAT'S PRIMARILY DONE FOR FUNDING PURPOSES. AND WITHIN AFTER 24 HOURS, THE MARIN COUNCIL IS AUTHORIZED TO BRING THAT PROCLAMATION BACK TO THE MARIN COUNCIL FOR, UH, CONTINUING, UH, MANDATING OR, OR TERMINATING. UM, THE ORDINANCE THAT WAS DRAFTED WOULD ACTUALLY, IF THE MAYOR WERE TO DECLARE AN EMERGENCY, UM, IT WOULD EXPIRE WITHOUT FURTHER ACTION. 90 DAYS FROM THE DATE OF DECLARATION, IT WOULD ALSO REQUIRE THAT AT THE NEXT REGULARLY SCHEDULED COUNCIL MEETING AND EVERY 30 DAYS THEREAFTER THAT THE PROC THE EMERGENCY SITUATION BE REVIEWED AT AMERICAN COUNCIL MEETING. UM, SO, AND OF COURSE IT WOULD NOT. THE MAYOR AND COUNCIL WOULD ALWAYS RETAIN THE RIGHT AT ANY TIME TO ACT ON THE DECLARATION OF AN EMERGENCY, JUST LIKE THEY CURRENTLY HAVE THAT POWER. NOW I'M HAPPY TO ANSWER ANY QUESTIONS. I HAVE A QUESTION THAT'S A MUMBRELLAS WELL, WAIT, BEFORE YOU DO YOUR PRESENTATION, I WANTED TO ASK MY UNDERSTANDING IS WE NEVER REALLY HAVE A CONVERSATION ABOUT THIS, BUT NOW THE QUESTION THAT I HAVE, YOU MENTIONED THAT, UM, CURRENTLY MAYOR CAN CALL IN A STATE OF EMERGENCY AND THEN WITHIN 24 HOURS, THE MAYOR IS REQUIRED TO PULL IN COUNCIL. SO ISN'T THAT WHAT YOU JUST SAID? NO, IF I MAY CLARIFY MAYOR COUNCIL MEMBER ELLIS UNDER OUR CURRENT CODE, THE MAYOR MAY DECLARE AN EMERGENCY TO EXIST. AND AFTER 24 HOURS, THE COUNCIL CAN BRING IT TO A MEETING TO ACT ON IT, CONTINUE IT, GET A RE YOU KNOW, WHATEVER YOU WANT TO DO. UM, THAT'S BUT IT WOULD, THE EMERGENCY WOULD EXIST UNTIL THEY COUNCIL TOOK AFFIRMATIVE ACTION TO DETERMINE THAT IT SHOULD BE TERMINATED. [00:35:01] OKAY. SO IN THE CURRENT ONE, WHAT IS THE CHANGE THAT IS BEING PROPOSED? IS THAT AN, IF A MAYOR WERE TO DECLARE AN EMERGENCY TO EXIST, IT WOULD EXPIRE AUTOMATICALLY 90 DAYS AFTER IT IS DECLARED. AND THEN AFTER THE 90 DAYS, BECAUSE YOU SAID EARLIER, SORRY, YOU SAID EARLIER THAT THIS IS PURPOSELY FOR FUNDING AND I, AND I CAN'T IMAGINE FUNDING WILL FINISH WITHIN 90 DAYS. AND IF I MAY MAYOR, UM, UNDER STATE LAW, UM, TITLE 26 OF OUR ARIZONA REVISED STATUTES, YOU CAN DECLARE, UH, THE MAYOR IS AUTHORIZED TO DECLARE A LOCAL EMERGENCY IF AUTHORIZED, PURSUANT TO OUR CODE NIAS, UM, IN THIS SITUATION. AND IT PROVIDES ACCESS TO EMERGENCY FUNDING, BOTH FROM THE STATE AND THE FED FEDERAL GOVERNMENT. AND IF I MAY MAYOR, JUST TO CLARIFY ONE FURTHER THING, COUNCIL, UM, THE WAY THIS ORDINANCE IS WRITTEN, UM, COUNSEL COULD TAKE ACTION AT ANY TIME TO EXTEND THE PROCLAMATION, UM, THE DECLARATION OF AN EMERGENCY TO AMEND IT, OR TO TERMINATE IT EARLIER, IF, IF THE COUNCIL WEREN'T INCLINED TO DO SO, BUT YOU'RE SAYING THAT AT THAT TIME IT CAN BE CHANGED BY CONSOLE, CORRECT. SO WE COULD NOT RECEIVE THE MONEY OR SAY NO TO THE MONEY. YES. AND I MEAN, LET ME JUMP IN NEXT. SO, YOU KNOW, FROM MY PERSPECTIVE, THIS JUST PUTS A SUNSET ON AN EXISTING EMERGENCY CLAUSE. UM, IF THE, WE HANDLED THIS EXTREMELY WELL IN CHANDLER, AND I MADE SURE THAT I WAS IN CONVERSATION WITH COUNSEL AND ANY TIME THAT, UH, WE HAD SOME DECISION POINTS, THE GOVERNOR RECENTLY, UH, PUT A TWILIGHT OR A SUNSET ON IT, A STATE ONE, I BELIEVE FOR SIX MONTHS. SO OURS IS, IS, UH, TO THREE. IT DOESN'T MEAN THAT IT HAS TO BE OVER. IT JUST MEANS THAT, UH, THIS RESTORES THIS, THAT COUNCIL, ALTHOUGH YOU CAN CHANGE IT, STOP AT ANY TIME WITH A VOTE OF COUNCIL. THIS JUST BRINGS US BACK TO COUNCIL. IN OUR CASE, WE DID THAT ANYWAY. UH, BUT WE DON'T KNOW WHO'S GOING TO BE HERE IN THE FUTURE. WE DON'T KNOW WHAT FUTURE LEADERS WILL BE HERE. AND I WILL BE HONESTLY SURPRISED IF, UH, ANY OF US WILL EVER SEE ANOTHER EMERGENCY DECLARATION ORDER THIS IN ALL THE YEARS I'VE BEEN SERVING OUR, UH, ALL THE YEARS THAT OUR CITY ATTORNEY HAS BEEN SERVING. THIS IS THE FIRST AND ONLY, UH, SO THIS MIGHT BE THAT IT REALLY AN EXERCISE OF DEMOCRACY RATHER THAN PRACTICAL APPLICATION, BUT IT DOES, IT DOES PUT A TWILIGHT ON THERE AND, UH, ALLOWS COUNCIL TO, UH, IN ESSENCE, SAY, IF THIS IS GOING TO CONTINUE, WE CAN DO IT. FUTURE MAYORS ALSO HAVE THE, THEY COULD TURN AROUND AND DECLARE ANOTHER STATE OF EMERGENCY RIGHT AFTERWARDS, IT WOULD NOT PREVENT THAT, BUT IT REALLY JUST BRINGS COUNCIL BACK INTO THE FOLD IN THE MIX. AND WE MET WEEKLY, UH, WHILE IN THE FIRST DAYS OF COVID AND WITH AN EXACT SESSION TO KNOW THAT WE'RE UP TO DATE. AND THEN, UH, ONCE AND THEN REGULARLY MOVED BACK A LITTLE BIT LATER. SO WE HAD TREMENDOUS COMMUNICATION WITHIN OUR CITY, BUT THIS JUST PUTS IT AT A 90 DAY. UM, TWILIGHT COUNCIL MEMBER HARRIS, JUST, UM, UH, I, I DID GET A CHANCE TO TALK TO A COUNCIL MEMBER. I'M STILL WORRIED ABOUT IT. I JUST HAD A QUESTION. IT JUST CAME TO ME WHEN WE WAS TALKING. IT WAS, UM, SO TYPICALLY THE MAYOR CALLS TO MEETINGS, CORRECT KELLY. WELL, LIKE THE MAYOR CONTROLS IN, IN TYPICAL FASHION, THE MAYOR TYPICALLY CONTROLS THE MEETINGS FOR, UM, FOR CITY COUNCIL AND AMBASSADOR VIEQUES AND DANA DANA, WHO CONTROLS THE MEETINGS, SORRY. UM, COUNSEL THROUGH THE AMERICAN COUNCIL MEMBER HARRIS. UM, I THINK BASED ON THE CHARTER, THE CHARTER STATES, YOU KNOW, WHEN, UM, MEETINGS NEED TO BE HELD AND THEN SPECIAL MEETINGS CAN BE CALLED BY THE MAYOR OR, UM, NUMBER OF THE COUNCIL MEMBERS. OKAY. SO I GUESS MY ONLY THING WAS JUST IF, IF, IF ONE COUNCIL MEMBER IS CHALLENGING THE MAYOR ON CALLING THE EMERGENCY, WHAT WILL IT TAKE FOR, OR WHAT'S THE PROCESS, IF WE'RE SAYING, HEY, MAYOR, WE DON'T AGREE WITH YOUR STATE OF EMERGENCY. WE WANT TO DO A 24 HOUR MEETING. WHAT IS THAT PROCESS AFTER THAT? CAUSE I DON'T KNOW WHAT THAT PROCESS IS. WHAT DO I, YOU KNOW, CAUSE IT'S, I UNDERSTAND THAT THEY'RE, YOU KNOW, TRYING TO HELP BALANCE THE POWERS, BUT I DON'T KNOW WHERE THE POWER THIS SHIFT IS. DOES IT GOES TO THE VICE MAYOR, WHO'S THE SECOND HEAD OF STATE. HOW DO WE, HOW DOES THE COUNCIL ACT ON CALLING A MEETING? IF THE MAYOR IS SAYING, I WANT THIS TO BE IN PLACE, HOW DOES WE AS COUNCIL MEMBERS EMPOWER OURSELVES AND SAY, WE'RE GOING TO CALL A MEETING TO CHALLENGE THE STATE OF EMERGENCY THAT WE HAVE [00:40:01] THE RIGHT TO DO WITHIN A 24 HOUR PERIOD OF TIME. SO WHAT I'M ASKING IF I MAY MAYOR, UH, COUNCIL MEMBER HARRIS, UM, THERE ARE, WE HAVE COUNCIL RULES AND PROCEDURES ON HOW THINGS ARE PUT ON THE AGENDA. AND BASICALLY ANY COUNCIL MEMBER CAN REQUEST AN ITEM ON AN AGENDA IF IT'S A SHORT, IF IT'S WITHIN A SHORT PERIOD OF TIME AND I'M LOOKING REAL QUICK TOO. AND I APOLOGIZE, UM, IF IT'S, IF IT'S LIKE WITHIN 48 HOURS OR AFTER THE AGENDA'S BEEN POSTED, THEN IT TAKES TWO OR MORE COUNCIL MEMBERS TO PUT SOMETHING ON AN AGENDA. SURE. W WHAT I WOULD LIKE TO DO, AND WE DON'T HAVE TO, UH, WHAT I WOULD LIKE TO DO IS I WOULD LIKE TO FLUSH OUT THAT, WHAT THAT LOOKS LIKE. CAUSE I REALLY, EVEN WHAT YOU'RE SHARING WITH ME AND I'M SORRY THAT I'M PUTTING YOU ON THE SPOT. CAUSE I JUST THOUGHT ABOUT IT LITERALLY, JUST NOW ABOUT HOW, IF I DISAGREE WITH THE MAYOR AND I WANT TO CHALLENGE THE, UM, THE STATE OF EMERGENCY THAT YOU SAID I HAVE 24 HOURS TO CHALLENGE IT. I JUST WANT TO KNOW AS A COUNCIL MEMBER, WHAT IS MY PROCESS TO CHALLENGE IT, IF IT EVER COMES. AND I KNOW THESE ARE EXTRAORDINARY CIRCUMSTANCES, BUT WHAT WE ABOUT TO DO IS MAKE A LIFETIME DECISION. SO I JUST KIND OF WANT TO MAKE SURE I'M COOL WITH EVERYTHING ELSE WITH THE D'S. I JUST WANT TO MAKE SURE MY PROCESS, I UNDERSTAND MY PROCESS AS A COUNCIL MEMBER TO SAY I'M CHALLENGING THAT OFFICE, THIS POSITION ON AN EMERGENCY. SO IF I MAY, I HAVE THE ANSWER, IF I MAY, MAYOR COUNCIL MEMBER HARRIS, UM, IT D R THE COUNCIL RULES AND PROCEDURES SAY ALL AGENDA ITEMS TO BE SUBMITTED BY STAFF TO THE CITY COUNCIL SHALL BE DELIVERED TO THE CITY MANAGER NO LATER THAN 12:00 PM ON THE THURSDAY OF THE WEEK, PRIOR TO THE COUNCIL MEETING, FOR WHICH THOSE ITEMS ARE TO BE CONSIDERED AFTER THAT TIME FOR STAFF TO SUBMIT MATTERS ON THE AGENDA FOR EITHER THE STUDY SESSION OR THE REGULAR COUNCIL MEETING THE FOLLOWING WEEK, THE CITY MANAGER MUST HAVE THE APPROVAL OF THE MAYOR OR THREE COUNCIL MEMBERS. UM, AND ANY MEMBER OR MEMBERS OF THE COUNCIL, MESA, MIDNIGHT OF THEM FOR THE COUNCIL AGENDA PRIOR TO NOON ON THE THURSDAY OF THE WEEK, PRIOR TO THE WEEK OF THE COUNCIL MEETING, UM, THE SAME COUNCIL MEMBERS WHO SUBMITTED, OH, I'M SORRY, THAT'S WITHDRAW. WE'LL SKIP THAT. UM, AND THEN IF IT'S SOONER THAN THAT SOONER, OR AFTER THE THURSDAY, IF IT'S QUICK, CLOSER TO THE COUNCIL MEETING, THEN IT TAKES, UM, THREE COUNCIL MEMBERS. OKAY. SO, SO BASICALLY IN ORDER, SO WITH RESPECT TO THE OFFICE, SO WE'RE NOT TALKING ABOUT YOU MAY OR WE TALK ABOUT THE OFFICE THAT YOU CARRY. UM, SO IF THE, IF THE, IF THE OFFICE OF THE MAYOR CAUSES A STATE OF EMERGENCY, THEN IF THE COUNCIL WANTS TO CHALLENGE THE STATE OF THE EMERGENCY AND SAY, HEY, OFFICE OF THE MAYOR, WE NO LONGER WANT, WE WANT TO CHALLENGE YOUR POSITION ON THIS EMERGENCY. THEN MY JOB WOULD BE TO CALL TWO, THREE OF MY COUNCIL MEMBERS TO GET BACK WITH YOU WITHIN A, SO THE RULES IS GOING TO CHANGE A LITTLE BIT, CAUSE YOU'RE TALKING ABOUT 24 HOUR SPAN. SO IF HE SAID THAT IF THE MAYOR, THE OFFICE OF THE MAYOR SET THE EMERGENCY, THEN WE HAVE 24 HOURS TO CHALLENGE THE EMERGENCY. NOW, MATE, IF I CAN CLARIFY THAT, UM, UNDER THE CURRENT CODE, AFTER THE MAYOR DECLARES AN EMERGENCY, AFTER 24 HOURS, THE COUNCIL CAN BRING THAT TO THE MAYOR AND COUNCIL AT ANY TIME TO CONSIDER. AND THE REASON THE 24 HOURS IS THERE IS BECAUSE YOU HAVE TO POST NOTICE OF A MEETING AT LEAST 24 HOURS IN A DAY. SO IF HE SAYS 24 HOURS, THEN THAT MEANS THAT, UM, AFTER 24 HOURS, LET'S SAY HE HE'S, HE POSTS A MEETING AND SAYS, OKAY, I'M DECLARING A STATE OF EMERGENCY. AND THEN, UM, HE AUTOMATICALLY DOES THAT. 24 HOURS GOES BY COUNSEL SAYS, HEY, I DON'T AGREE WITH THAT STATE OF EMERGENCY. THEN I HAVE TO RECRUIT THREE COUNCIL MEMBERS TO GO TO THE CITY MANAGER FOR HIM TO PUT IT ON AN AGENDA FOR HIM TO, FOR US TO HAVE A DISCUSSION OR OVERTAKEN. NOW, THIS IS MY NEXT QUESTION. IF THAT DOES HAPPEN, WHY, WHY CAN THE OFFICE OF THE MAYOR DECLARE EMERGENCY, UM, THAT FAST? AND THEN IT TAKES THE COUNCIL MEMBERS. YOU TAKE THREE COUNCIL MEMBERS, AND THEN WE HAVE TO WAIT LIKE TWO, THREE WEEKS TO CHALLENGE IS SHOULDN'T THERE BE A CLAUSE THAT SAYS THAT WE CAN CHALLENGE IT JUST AS FAST AS HE GAVE IT, BECAUSE LET'S SAY HE SAID WE HAVEN'T HAD FLOODS AND WE DON'T AGREE THAT THERE IS FLOODS GOING ON. HE DECLARES THE EMERGENCY. WE SHOULDN'T HAVE TO WAIT TWO, THREE WEEKS OR SO FOR THE NEXT AGENDA, WE SHOULD BE ABLE TO HAVE A REP. YOU KNOW, IF WE'RE GONNA, I MEAN, CAUSE IF WE'RE CHECKING THE BALANCE OF POWER, THEN THAT MEANS THAT WE SHOULD BE ABLE TO SAY HE DID IT IN 24 HOURS. OKAY. BOOM. WE WAIT 48 HOURS. NOW THREE COUNCIL MEMBERS HAVE CAME IN AND CHALLENGED IT. THE EMERGENCY SHOULDN'T CONTINUE. IF THREE COUNCIL MEMBERS IS CHALLENGING, IT, THERE SHOULD BE A CLAUSE IN THERE TO SAY, IF HE DECLARES IT, THE COUNCIL DECIDES TO OVERTURN IT. THEN IT SHOULDN'T TAKE WEEKS A WEEK FOR US TO DO IT BECAUSE SOMETIMES WHEN THE EMERGENCY HAPPEN, WE ARE SOMETIMES WITHIN THREE WEEKS OR A MONTH [00:45:01] OUT BEFORE OUR NEXT COUNCIL MEETING IN THE EMERGENCY IS STILL GOING ON WITHOUT US HAVING THAT CONVERSATION. SO I JUST KIND OF WANT TO MAKE SURE THAT WE HAVE IN THAT CLAUSE OR WHATEVER THAT NEEDS TO LOOK LIKE. CAN WE TALK ABOUT THAT? CAN WE ADD THAT IN THERE? I MEAN, I JUST WANT TO BETTER UNDERSTAND THAT THAT'S I REMEMBER LET ME ADDRESS THIS PLEASE. SO RIGHT NOW I BELIEVE COUNSEL CAN CALL A SPECIAL MEETING AS WELL. YOU DON'T HAVE TO WAIT, BUT THAT'S THE WAY IT IS NOW WHAT THIS ADDS, IS IT JUST A TWILIGHT? SO THE WAY UNDER A PREVIOUS STATE OF EMERGENCY, AND THIS IS PRETTY WELL BOILER PLATE VERDE CITY COUNCIL CAN SAY, THE MAYOR IS WRONG. WE CAN MEET AND CALL A SPECIAL MEETING. THE 24 HOURS AFTER ANY TIME IS JUST THE AMOUNT OF TIME THAT IT TAKES IN ORDER TO NOTIFY THE PUBLIC. SO IT DOESN'T TAKE TWO WEEKS, THREE WEEKS, A MONTH. COUNCIL CAN DO THAT AT ANY TIME. THERE IS ONE CITY, FOR EXAMPLE, THAT THEIR COUNSEL DISAGREED WITH THE MAYOR AND THEY WENT BACK TO CALL THE SPECIAL COUNCIL MEETING. AND, UM, IN ESSENCE, LISTENED TO THE MAYOR AND THEN THEY, THEY MODIFIED SOME OF THE CONDITIONS OF THAT. SO COUNCIL HAS THAT OPTION. THIS IS JUST RESTRICTING FURTHER WHAT WE CURRENTLY HAVE BY AUTOMATICALLY TWILIGHT ING IT. AND JUST THIS LAST TIME, W OUR STATE OF EMERGENCY WITH COVID WENT ON FOR MANY, MANY MONTHS AS DID EVERY CITY'S AS DID THE STATES. THIS WOULD JUST MAKE COUNCIL HAVE TO FURTHER RATIFY IT IF IT WOULD CONTINUE AFTER A CERTAIN TIME. SO ALL THE ALL DAY ASSURANCES THAT YOU'RE LOOKING FOR ARE IN THERE. THIS JUST ADDS A CONDITION OR AN ADDITIONAL ONE THAT WOULD SAY AFTER 90 DAYS, THIS AUTOMATICALLY TWILIGHTS. SO IF YOU, SO IF YOU DON'T SAY ANYTHING ELSE ABOUT THE ISSUE, THE STATE OF EMERGENCY HAPPENS, IT JUST SAYS BASICALLY IN 90 DAYS, THIS IS GOING TO STOP WHATEVER THE STATE OF THE EMERGENCY IS GOING TO AUTOMATICALLY PUT INTO THE END. I WAS JUST, MY, MY CONCERN WAS JUST, I DIDN'T GET A CHANCE TO, UM, I DIDN'T UNDERSTAND THE PROCESS OF WHAT THAT LOOKS LIKE FROM A COUNCIL MEMBER. WE'RE CHECKING THE POWERS OF IT. I'M OKAY WITH THE CLAUSE. I JUST WANTED TO BETTER UNDERSTAND WHAT IS THE PROCESS OF THE COUNCIL MEMBERS. SO WHEN WE CHALLENGED, UM, THE OFFICE OF THE MAYOR, WE CAN, WHEN OTHER COUNCIL MEMBERS CHALLENGED THE OFFICE OF THE MAYOR THAT WE UNDERSTAND AT THE COUNCIL, THAT IT TAKES THREE OF US VERSUS LIKE THE THING THAT WE ALWAYS DO, IT TAKES THREE OF US TO SAY, WE WANT A SPECIAL MEETING TO CHALLENGE THIS PARTICULAR ISSUE. OKAY. THAT'S, THAT'S KINDA WHAT I WANTED TO BETTER AND THAT'S INSIDE OF THE DOCUMENT. OKAY. ALL RIGHT. I JUST WANT TO MAKE SURE SEND THAT OVER TO ME SO I CAN MAKE SURE I JUST DOUBLE READ THAT AGAIN, TO MAKE SURE THAT THE AX SEE THAT IN THERE. SO THAT WAY WE CAN, I CAN FEEL COMFORTABLE. AND I, AND I, I BELIEVE THAT IT IS THERE, BUT I WANTED TO MAKE SURE, CAUSE I MAY HAVE LOOKED OVER IT BY SOME CIRCUM, HALF THE STANCE OR WHATEVER. IT'S STILL IN YOUR AGENDA. THAT'S STILL IN MY AGENDA. WHAT I WILL HAVE A LOT OF TIME TO READ BETWEEN NOW AND THURSDAY FOR I VOTE ON THIS. THANK YOU, MATT. DID ANY OF THAT ANSWER YOUR QUESTION? OH NO. I JUST WANT TO GET MARK, TO BE HONEST WITH YOU. YOU WANT TO HEAR WHAT YOU HAVE TO DO? HAVE A COUPLE OF THOUGHTS. I TRIED TO JUMP OUT IN FRONT ON THIS, BUT, BUT IT'S GOOD THAT WE'RE KIND OF VETTING THAT OUT, WHICH IS THE PURPOSE FOR THE INITIATION OF THE ORDINANCE IS FOR US TO SIT ON THE DICE AND CHAT ABOUT WHY THE EMERGENCY ORDER WAS CALLED. AND THEN, SO THIS ORDINANCE WILL EFFECTIVELY FORCE A CONVERSATION. NOW WE ARE SO LUCKY THAT THAT MAYOR HARKEY WAS IN CHARGE DURING COVID AND THAT THERE WAS COLLABORATION FROM THE BEGINNING TO THE END. WE WERE TALKING EVERY WEEK, WE WERE ON THE PHONE ALL THE TIME, THIS ORDINANCE TO ENSURE THAT THAT HAPPENS IN THE FUTURE WHEN SOMEBODY ELSE IS IN SITTING IN THAT CHAIR SO THAT THERE HAS TO BE A CONVERSATION ON A DYESS AND THAT THERE IS SUNLIGHT TO THE EMERGENCY ORDER AND THAT EVERY 30 DAYS OR THE FIRST FORMAL MEETING BEFORE THAT 30 DAYS, THERE'S A CONVERSATION. AND THEN THERE'S ANOTHER CONVERSATION THAT 30 DAYS, AND AT THE END OF THAT 90 DAYS, THIS WOULD SUNSET UNLESS COUNCIL DECIDES TO RATIFY OR CONTINUE TO MOVE FORWARD WITH THE, WITH THE ORDINANCE. SO THIS IS NOT, UH, THIS WILL NOT PRECLUDE THE MAYOR FROM INITIATING AN EMERGENCY ORDER. WHAT IT WILL DO IS WE'LL ENHANCE THE SUNLIGHT ON WHY THE EMERGENCY HAPPENED, WHY THE EMERGENCY ORDER HAPPENED. SO THE PUBLIC IS AWARE THAT'S THAT'S IT. SO, OH, THANKS. SORRY. THANK YOU MAY FOR RECOGNIZE ME. APPRECIATE IT. SO CUSTOMER STOOD, I WAS JUST CURIOUS, WHY DIDN'T WE JUST MODEL THE STATE'S LAW AND PUT IT SIX MONTHS, THREE MONTHS, SEEM SUCH A SHORT TIME TO SUNSET A WALL. WHEN AS INDICATED EARLIER, PROBABLY MONEY WON'T EVEN START FLOWING FOR SEVERAL MONTHS AFTERWARDS AND ALL THE PAPERWORK THAT GOES THROUGH THE PROCESS ALONE, JUST TO GET EMERGENCY RELIEF FUNDS. UM, W I MEAN, WHAT ARE YOU A MEANINGFUL TO MAKE IT A LITTLE BIT LONGER? LIKE SIX MONTHS IN MAX, THE STATE LAW? [00:50:02] WELL, THERE'S A LOT BEHIND THAT QUESTION AND PROBABLY I CAN ANSWER THAT WITH YOU ON THE PHONE, BUT I'LL TELL YOU THIS, THAT BEING TETHERED TO HOW WE RUN THE CITY BASED ON FEDERAL AND STATE FUNDING, BASED ON HOW THAT WAS HANDLED DURING COVID IS NOT A PRACTICE THAT I THINK WE WANT TO CONTINUE TO, UH, TO EXERCISE IN THE UNITED STATES, BUT THAT'S A WHOLE NOTHER CONVERSATION THAT WE CAN GET INTO PHILOSOPHICALLY TETHERING, A CITY TO FEDERAL DOLLARS BASED ON HOW WE WANT TO RUN OUR CITY, WHETHER IT'S AN EMERGENCY OR IT'S AN EXTENDED EMERGENCY, UH, IS NOT THE WAY THAT IT SHOULD BE HANDLED. SO IF IN FACT WE WERE TO DISCONTINUE OUR EMERGENCY ORDER, WHAT GOVERNOR DUCEY THEN MAKE THE REST OF OUR TAXPAYERS AND OUR CITIZENS SUPPER. IF WE DIDN'T HAVE THAT MONEY, OR WOULD THE PRESIDENT BIDEN OR TRUMP AT THAT TIME SAY, NOPE, SORRY, CHANDLER, YOU DON'T GET TO GET THIS MONEY, BECAUSE EVEN THOUGH YOU HAD THE IMPACT OF COVID, BECAUSE YOU DECIDED TO TELL YOUR PUBLIC THAT IT WAS SAFE TO BE, UH, TO MOVE AROUND FREELY. UH, I DON'T THINK THAT'S THE WAY THAT YOU SHOULD HANDLE BUSINESS, BUT I UNDERSTAND THAT THAT COULD BE THE REASON. SO THAT'S WHY WE SET IT AT 90 DAYS. SO I GUESS I GOT TO GO TO THE, I GUESS I'M CONCERNED WITH WHAT WE JUST SAID HERE. ARE YOU SAYING THAT THE REASON WHY I LEAVE DECLARED EMERGENCY FOR SEVERAL REASONS, ONE OF THEM IS BECAUSE WE'RE TELLING THE FEDERAL OR STATE GOVERNMENT OR KELLY, IT MAY BE THAT WE HAVE AN EMERGENCY AND WE NEED YOUR HELP. SO ARE WE SAYING HERE THAT WE DON'T WANT THEIR HELP? THAT'S THAT'S YOUR QUESTION? I CAN'T ANSWER THAT FOR YOU. NO, THAT'S LESS. THAT'S WHY I'M ASKING YOU. WHY, WHY DO WE HAVE TO SUNSET THIS WHEN WE WANT TO KEEP IT GOING UNTIL THE, THE RE THE, THE, THE, UH, RESOURCES ARE COMING IN. IF THAT'S WHAT YOU THINK YOU CAN, YOU'RE WELCOME VOTE NOW. NO, THAT'S AN UNDERSTOOD. THIS IS NOT MY AGENDA ITEM. THE REASON WHY WE HAVE EMERGENCIES AND WE ADDRESSED THIS ALREADY IS BECAUSE, AND WE'VE REASONABLY KEPT. THE OTHER ONE GOING IS BECAUSE WE HAVE FEDERAL DOLLARS HELPING US, OUR BUSINESSES, OUR LOCAL RESIDENTS, OUR OWN STAFF, AND GETTING MASKS. AND WHAT WE'RE SEEING HERE IS IF WE DON'T LIKE THE FEDERAL GOVERNMENT, I'M HEARING, IF WE DON'T WANT THE MONEY COMING FROM THE FEDERAL GOVERNMENT THREE MONTHS, WE CAN JUST SHUT IT OFF. OR YOU CAN HAVE ANOTHER MEETING AND YOU CAN VOTE TO CONTINUE IT, UH, OR YOU CAN HAVE ANOTHER MEDIA AND YOU CAN VOTE TO CONTINUE. YOU'RE WELCOME TO VOTE. NO COUNCIL MEMBER ORLANDO. NO, I'M NOT COUNCIL MEMBER. I'M NOT ARGUING THE LYDIA. I'M ASKING YOU WHY NOT SIX MONTHS IN ORDER TO BE ABLE TO GET US A PROCESS IN PLACE TO BE ABLE TO RECEIVE ANY POTENTIAL FUNDING. THAT'S ALL I'M SUGGESTING WHAT THE STATE DID. OKAY. KIND OF A MAYOR. AND THEN WE'RE SAYING, QUESTION IS YES. SO YEAH. SO SIX MONTHS IS NOT THE STATE. WHAT WE DID WITH THE STATE IS NOT, NOT GOOD ENOUGH HERE. YOU WANT TO BE THREE MONTHS. WHAT WE WANT TO DO IS HOLD FUTURE COUNCILS AND MAYORS TO THE SAME STANDARD THAT KEVIN SET. CAUSE IT WAS HANDLED PERFECTLY. THAT'S WHAT WE'RE TRYING TO DO. THAT'S NOT WHAT I'M SAYING. COUNCIL MEMBER. I'M NOT TRYING TO PIN YOU DOWN HERE. I'M JUST SAYING THAT THE STATE SAID SIX MONTHS IS A GOOD TIME FOR US TO BE ABLE TO GO BACK TO THE GOVERNOR AND SAY, HEY, WE WANT TO VOTE TO EXTEND THIS OR NOT. AND AGAIN, THIS WAS RATIONALIZATION ON THAT. ACCORDING TO THE LAW WAS THAT BECAUSE THERE'S A NEED ENOUGH BUFFER TIME TO GET ALL OF THE TEETH, THE TERMS AND CONDITIONS AND EVERYTHING ELSE DONE TO GET THE FEDERAL DOLLARS OUT. MY QUESTION IS WHY DON'T WE JUST MAKE THE SIX MONTHS IN CONGRUENT TO THE STATES? THEY'LL KEEP IT SUNSET. WOULD YOU WANT THE STATE STATES DOING, BUT GIVE US SOME TIME TO BE ABLE TO ALLOCATE THE RESOURCES. BUT SECOND QUESTION IS, I'M SORRY. GO AHEAD. SO IF, IF THIS SUNSETS CITY ATTORNEY, COULDN'T THE NEXT DAY, THE MAYOR SAY I'M BLAMING THE STATE OF EMERGENCY, UM, MAYOR, IF I MAY COUNCIL MEMBER ORLANDO. YES. THAT COULD HAVE BEEN, SO WHAT GOOD WE DONE? WHAT HAVE WE DONE THE NEXT DAY? THE AMERICANS SAY, OKAY, THANK YOU VERY MUCH FOR YOUR ADVICE AND DECLARED A STATE OF EMERGENCY BECAUSE OF THESE REASONS. AND THAT'S A MEMBER OF LANDO. ONE OF THE THINGS THOUGH, IF LET'S SAY A FUTURE MAYOR DECIDED TO DO THAT AND THE WILL OF THE COUNCIL WAS NOT TO EXTEND IT. THEN WITH THE CONVERSATION THAT WE JUST HAD BROUGHT UP BY COUNCIL MEMBER HARRIS IS THAT THE COUNCIL CAN BASICALLY VOTE THAT DOWN AT ANY TIME LIKE THIS COUNCIL COULD HAVE. SO, UH, IF THERE IS, YOU KNOW, AGAIN, IF YOU IT'S VERY POSSIBLE, IF, IF YOU KNOW, THERE CAN BE AN AMENDMENT OF THIS TO SIX MONTHS YET, IT'S REALLY THE WILL, WHATEVER Y'ALL WANT TO DO ON THURSDAY. SO THAT'S MORE, LIKE I SAID, I HAD NO PROBLEM WITH WHAT YOU'RE TRYING TO DO HERE. IT DOESN'T MAKE IT MAKE SENSE. I'M JUST SUGGESTING WE, WE JUST COINCIDED WITH THE STATE LAW AND THAT'S ALL MY SUGGESTION [00:55:01] IS HERE. AND THEN WE CAN MOVE. I'LL MOVE FORWARD WITH THAT. IF WE COULD GET THE EXTRA TIME TO, WE GIVE US THE ABILITY TO GET THE RESOURCES, IT'S GOING TO BE SEVERAL MONTHS JUST TO GATHER THE DATA POINTS ON SOME OF THESE THINGS, NEVERTHELESS, BE ABLE TO RESPOND IN A MANNER. SO THAT'S WHY I'M SUGGESTING COUNCIL MEMBER PRUDENCE APPROVAL APPLY HERE AND MAKE IT SIX MONTHS VERSUS THREE MONTHS. YES. THANK YOU. MA'AM MAY OR MAY SAY SOMETHING. YEAH. UM, YEAH, I THINK WE'RE, UM, COUNCIL MEMBER, MATT, WE'RE SAYING THE SAME THING, BUT I ACTUALLY, I ACTUALLY LIKED THE 90 DAY THING ONLY BECAUSE ON THE 89TH DAY, I CAN SAY, WE'RE, WE'RE STILL TETHERED TO MORE MONEY AND WE CAN EXTEND IT TOGETHER TO GO A LITTLE BIT FURTHER. SO IT KIND OF, TO ME, I LIKED THE 90 DAY BECAUSE IT GIVES US MORE TIME TO CONTINUE TO TALK ABOUT WHATEVER THE PREVAILING ISSUE IS. AND, AND SIX MONTHS CAN BE A VERY LONG TIME IN, IN THIS, IN THIS WORLD WE'RE DOING, I ACTUALLY LIKED THE 90 DAY. UH, I ACTUALLY LIKED THE 90 DAY. I KNOW THAT YOU WANT TO COINCIDE WITH THE SIX MONTH LAW, BUT I LIKE US TO CONTINUE TO HAVE THESE ROBUST CONVERSATIONS THROUGHOUT THE TIME. SO I LIKED THE 90 DAY. WE WANT TO GO 90 MORE DAY, LET'S DO IT. WE WANT TO GO A YEAR, LESS DO IT, BUT I DO LIKE THE 90 DAY. UM, BUT I DO UNDERSTAND THAT COUNCIL MEMBER, MATT, YOU'RE TRYING TO GET TO A PLACE TO JUST COINCIDE SIX MONTHS, SIX MONTHS. BUT I, I DO LIKE THE 90 DAY, CAUSE THAT GIVES ME AN OPPORTUNITY TO CONTINUE TO TALK ABOUT IT AND DECIDE IF I WANT TO EXTEND IT 90 MORE DAYS. AND I WOULD HOPE FOR, YOU KNOW, BOTH OF YOU AND EAT ON BOTH SIDES OF THIS ARGUMENT, THAT WHOEVER THE MAYOR IS, IF, AND WHEN THIS, UH, CLAUSE EVER IS POLLED, IS THAT YOU'RE GOING TO BE IN GREAT CONVERSATION. AND, AND COUNCIL CAN, AGAIN, WITHIN ONE DAY OR OUR 90 DAYS OR OUR 180 DAYS SAY THAT, HEY, THIS EMERGENCY NO LONGER EXISTS. AND, UH, WE'LL, WE'LL MOVE FROM THERE. BUT, YOU KNOW, WE SEAMLESSLY WORKED TOGETHER TO MAKE SURE THAT WE'RE IN COMMUNICATION AND GETTING THE BEST COUNSEL WE COULD FROM OUR CITY ATTORNEY, CITY MANAGERS AND OTHERS. AND I'M VERY CONFIDENT THAT FUTURE COUNCILS, THIS ISN'T GOING TO HAMPER THAT FUTURE COUNCILS WILL DO THE SAME. YEAH. COUNCIL MEMBER ELLIS. AND I THINK YOU SAID SOMETHING THAT IS VERY IMPORTANT CONVERSATION. HAD WE HAD THIS CONVERSATION PRIOR, EVEN IN AN EXECUTIVE MEETING AND DISCUSSING ALL THIS. I DON'T THINK WE WOULD HAVE BEEN AT THIS POINT NOW TRYING TO TEACH HER BACK AND ASKING FOR INFORMATION THAT SHOULD HAVE READILY BE GIVEN TO US BY CITY MANAGER AND ALSO THE, THE, UH, OUR ATTORNEY BASED ON THE INFORMATION I I'M GONNA SAY YES ON THIS, UH, ON THURSDAY. AND I WANT US TO STAY WITH THE 90, BUT IN THE FUTURE, I WOULD APPRECIATE IT. IF CONSOLE WOULD LIKE TO BRING ANYTHING TO PLEASE TAKE A MOMENT AND TALK TO US AND EXPLAIN WHAT WE'RE TRYING TO ACCOMPLISH. AND I THINK THAT WAS ALWAYS THE CHARGE THAT WE TALKED WITH EACH OTHER PRIOR TO COMING TO THE DIOCESE TO DISCUSS THIS KIND OF THING. SO THAT'S ALL I'M SAYING. ANY ADDITIONAL COMMENTS RELATED TO THIS? ALL RIGHT. THANK YOU. COUNSEL. NEXT [33. Council Focus Area(s):] ITEMS CALLED IN WERE BY MYSELF, BUT I BELIEVE COUNCIL MEMBER ORLANDO, UM, 33 AND 36. AND, UH, I'LL START OFF WITH A COMMENT. UM, THIS, WE JUST HAD A, UM, A WATER MEETING AND LOOKING AT OUR, OUR FLEXIBILITY, OUR NIMBLENESS, AND OUR ABILITY TO CONTINUE TO PROVIDE WATER FOR OUR COMMUNITY. AND I DO WANT TO THANK OUR STAFF. UH, CERTAINLY JOHN AND GREG AND SIMONE, WHO'VE BEEN LEADING US NOW WITH WATER ACQUISITION, WATER CONSERVATION. AND, UH, WHAT THIS IS GOING TO DO IS, IS TO CONTINUE TO GIVE US, UH, MORE SUSTAINABILITY, SOME MORE OPTIONS WITH OUR RECLAIMED WATER AND AS WELL AS THE POTENTIAL TO, UM, TO, UM, EVEN RECHARGE THIS WATER AND, UH, APPRECIATE OUR PARTNER INTEL AND WORKING WITH US. AND THIS IS GOING TO BE A GOOD THING FOR CHANDLER AS WE GO INTO DROUGHT. SO COUNCIL MEMBER ORLANDO, DID YOU HAVE A COMMENT OR DID YOU WANT A PRESENTATION? UH, MAYOR, I JUST WANTED THE PRESENTATION BECAUSE LIKE YOU SAID, THIS IS A, IT'S A GREAT, UH, A GREAT THING WE'RE DOING HERE. WE'RE ACTUALLY BRINGING OUR WATER BACK IN THE CHANDLER VERSUS CREDIT SOMEWHERE ELSE. AND I THINK THAT'S IMPORTANT FOR THE RESIDENCY HERE, UH, THAT WE ACTUALLY POSSESSION OF THE WATER VERSUS SOME CREDIT SOMEWHERE IN ANOTHER CITY. GREAT. JOHN CAN NEWTON IS WALKING UP TO THE DAYS, JOHN. WELL, THANK YOU. MARIN COUNCIL, UH, COUNCIL MEMBER ORLANDO, UM, TO YOUR QUESTION, UH, THIS PARTICULAR PROJECT REALLY IS A HAN HALLMARK PROJECT FOR THE UTILITY. [01:00:01] UM, THIS BEGAN AS AN IDEA FROM ONE OF OUR STAFF MEMBERS TO BRING WATER BACK TO CHANDLER AND RECHARGE IT IN OUR AQUIFERS UNDERNEATH CHAMBER, RATHER THAN, UM, RECHARGING IN OTHER CITIES, PEORIA AND OTHERS. UH, WHAT THIS DOES FOR US IS IT ALLOWS US TO ACTUALLY USE THE INFRASTRUCTURE THAT WE STILL HAVE IN PLACE OUR 33 WELLS TO ACTUALLY DRAW THAT WATER DURING DROUGHT. THE ADDITIONAL BENEFIT FOR THE ORIGINAL PROJECT WAS TO ACTUALLY, UH, ENHANCE THE ENVIRONMENT AND VETERANS OR WASTERS PARK BY ALSO BEING ABLE TO TAKE WATER, ADDITIONAL WATER OUT THERE FOR THE PONDS THAT WE USE FOR RECHARGE THAT ALSO, UH, ENHANCE THE ENVIRONMENT AND THE BIRDS, UH, THE WHOLE, THE WHOLE ECOSYSTEM AT VETERANS, THE WASTE AS PART, WE'VE BEEN ABLE TO ADD WATER TO THAT AS PART OF THIS PROJECT, THEN LATER ON, UM, WHEN INTEL ANNOUNCED THEIR, THEIR LARGE EXPANSION IN SOUTH CHANDLER, WE ABLE TO TAKE THIS VERY SAME PROJECT, DOUBLE THE SIZE IN AND BRING CHAN OR INTEL IN AS A PARTNER. AND WE BROUGHT THEM IN AS A 50% PARTNER TO THE PROJECT AND USING THE TECHNOLOGY THAT WE WERE ALREADY GONNA USE TO, TO INJECT WATER INTO THE GROUND, BRING ADDITIONAL WATER IN, TO SATISFY INTEL'S NEED FOR COOLING WATER. SO WE'VE BEEN ABLE TO TAKE A PROJECT THAT WAS INITIALLY, UH, CONCEIVED FOR THE ENVIRONMENT AS A SUSTAINABLE, UH, WATER RESOURCE PROJECT FOR THE CITY. AND THEN EXPAND THAT TO ENHANCE ENTAILS, UH, A NEED FOR WATER FOR THERE, A LARGE EXPANSION IN SOUTH CHANDLER. SO IT WAS REALLY A WIN-WIN FOR US. UM, HALF, UH, UH, HALF OF THE PROJECT IS BEING PAID FOR INTEL THROUGH AN AGREEMENT WITH THE DEPARTMENT OF REVENUE. SO IT'S ALSO A, UH, A GREAT, UH, A GREAT PARTNERSHIP IN THAT WAY AS WELL. COUNCIL MEMBER ORLANDO, ANY COMMENTS BEFORE I BRING IT TO THE COUNCIL? NO, MA'AM LIKE I SAID, I JUST WANT THIS AN IMPORTANT ISSUE TO, AND I'M GLAD WE HAD THE DISCUSSION EARLIER TODAY, AS WELL AS THE FOLLOWUP TODAY. THANK YOU CONSTANTLY. ANY ADDITIONAL COMMENTS OR QUESTIONS RELATED TO THE OF RIGHT. THANK YOU, JOHN. OH, OKAY. WE'RE HEARING YOUR CHILDREN. COUNCIL MEMBER ORLANDO. YEAH. ALL RIGHT. UM, COUNSEL WAS, I MENTIONED WE HAVE SEVERAL ACTION ITEMS ON THURSDAY, AS WELL AS A PUBLIC HEARING. UM, I BELIEVE THAT IS ALL THE QUESTIONS THAT WERE CALLED IN, AND THAT THEREFORE CONCLUDES OUR MEETING TODAY. WE'LL SEE YOU ALL ON THURSDAY. GOOD DISCUSSION. * This transcript was created by voice-to-text technology.
