I, I KNOW WHERE YOU'RE COMING FROM ON THIS AND I, AND I GET WHAT YOU'RE TRYING TO DO HERE, BUT, YOU KNOW, I HEARD LOUD AND CLEAR FROM A BUYER.

POLICE ARE RISK MANAGEMENT RECOMMENDING AND YOU KNOW, I LOVE ROBUST DISCUSSION WHERE ALL THREE OF THOSE PEOPLE, I WILL ALWAYS, I ALWAYS RELISH THAT DISCUSSION, BUT IN THIS SCENARIO HERE, UM, I REALLY, I REALLY CAN'T SUPPORT THIS BECAUSE I THINK IT DOES SENDS A CONFUSING LANGUAGE TO THE INDIVIDUALS.

I DO FEEL THERE IS A RISK MANAGEMENT HERE WITH PUTTING IN OUR STREETS OR ANY OTHER PUBLIC RIGHT AWAY, UH, WHICH THEN COULD POTENTIALLY BE A LIABLE OR LAWSUIT AGAINST US, WHICH WE HEARD LOUD AND CLEAR ON MONDAY NIGHT.

UM, THIS IS ON SOMEONE ELSE'S OWN PROPERTY.

THEY'RE RESPONSIBLE FOR ANY DAMAGE AT TYPE OF STUFF THAT THEIR HOMEOWNERS INSURANCE OR HER INSURANCE, BUT I JUST DON'T WANT TO PUT THE TAX THE BURDEN BACK ON THE TAXPAYERS ON THIS ONE.

BUT FURTHERMORE, THE REMOVAL OF THIS LANGUAGE FOR STREETS AND ROADS AND SIDEWALKS

BUT LET'S JUST SAY, FOR EXAMPLE, UM, THE LADY IS NOT FANS OF HER NEIGHBORS AND THE KIDS ARE OUT FRONT SETTING OFF SPARKLERS BY THIS CODE.

I MEAN, WE'LL, WE'LL CALL HER KAREN.

THAT'S A FACT OF THE MATTER BECAUSE THEY HAVE TO DO THAT.

WE HAVE THAT IN OTHER SITUATIONS, BY REMOVING THIS LANGUAGE, WE TAKE THE BURDEN OFF THE POLICE, WHICH IS A TAX BURDEN AND THE TIME THAT IT TAKES FOR THEM TO DO THAT BY REMOVING THIS LANGUAGE, WE ALLOW THE FREEDOM.

IN FACT, IN FACT, FRANKLY, I THINK THAT THIS ORDINANCE, AS IT WAS ORIGINALLY WRITTEN, DOESN'T FIT WITHIN THE SPIRIT OF CUSTOMER SERVICE.

WE'RE SUPPOSED TO PROVIDE AN AVENUE FOR PEOPLE TO ENJOY THE QUALITY OF LIFE, TO, UM, TO, TO LIVE THEIR LIVES.

AS THEY SEE FIT AND SETTING OFF ILLEGAL FIREWORKS OUT IN FRONT OF THEIR HOME SHOULD BE PERFECTLY FINE IN THE CITY LIKE CHANDLER, WE SUPPORT LIBERTY, WE SUPPORT FAMILY VALUES AND WE CERTAINLY SUPPORT CELEBRATION OF DEVALE CELEBRATION OF SINKING, THE MILES CELEBRATION OF 4TH OF JULY CELEBRATION OF A NUMBER OF OTHER THINGS THAT WE DO WITH FIREWORKS.

UM, AND SO BY MAKING PEOPLE MOVE THIS BACK TOWARDS THEIR HOME, I THINK THAT CREATES A FIRE HAZARD FOR PALM TREES, FOR ROOFS, UM, AND, AND THINGS LIKE THAT.

WE, WE WANT THEM OUT IN THEIR STREET.

WE WANT THEM OUT ON THE SIDEWALK.

AND I THINK THAT'S WHY THE REASON FOR THE MOTION, I DON'T WANT TO BE ON THE COUNCIL THAT TELLS KIDS THEY CAN'T SHUT OFF FIREWORKS IN FRONT OF THEIR HOUSE, ADDITIONAL QUESTIONNAIRE, COMMENTS, RIGHT.

UM, I THINK THAT, UM, I WANTED TO ASK, UH, CHIEF, UH, JUST A COUPLE OF QUESTIONS, UM, UH, CAUSE I JUST, I JUST NEEDED TO KNOW, UM, SHE, UM, THANK YOU THAT, UH, HOW, HOW MUCH LIKE, YOU KNOW, RIGHT NOW PEOPLE IN CHANDLER, THEY CAN GO TO THE STREETS, SHOOT THE FIREWORKS OFF CURRENTLY RIGHT NOW.

RIGHT.

SO HOW MANY ISSUES HAVE WE REALLY HAD? I MEAN, DO WE NEED TO MAKE THIS INTO A LOT, HOW WE HAD A LOT OF ISSUES AS IT PERTAINS TO THIS PARTICULAR ISSUE WITH VIRUS BEING LED OFF IN A CALL TO SET AS COUNCILLOR MARTIN STORY HAS ALLUDED TO THROUGH THE MAYOR COUNCIL MEMBER HARRIS, IF YOU'RE REFERRING TO ISSUES OF, OF, UH, INDIVIDUALS SHOOTING THEM OFF IN THE STREET, I THINK THAT'S WHERE MOST OF THEM ARE, ARE 90 RIGHT NOW, IF YOU'RE ASKING SPECIFICALLY THE CALL VOLUME AND THE AMOUNT OF FIRES THAT WERE RUNNING, UH, THE THREE HIGHEST DAYS FOR US ARE THE TWO HIGHEST DAYS RIGHT NOW, OUR 4TH OF JULY, WHICH IS THE BUSIEST DAY OF THE YEAR.

WE PULLED THE NUMBERS FOR THE LAST THREE YEARS FROM, WE GO FROM 6:00 PM TILL 2:00 AM.

AND THERE ARE MORE FIRE CALLS IN THAT TIMEFRAME THAN ANY OTHER TIME IN THE YEAR.

UM, AND SO THAT'S 4TH OF JULY AND THE OTHER ONE IS NEW YEAR'S EVE.

AND I BELIEVE IT WAS OVER THE LAST THREE YEARS.

IN THOSE THREE DAYS, WE RESPONDED TO 86 SPIRES.

I KNOW, UH, FROM THE METROPLEX POINT OF VIEW, THE CITY OF PHOENIX, ALL THE SURROUNDING JURISDICTIONS, 4TH OF JULY IS OUR BUSIEST NIGHT ON NOW, DOES THAT MEAN THAT THEY WERE LIT OFF, YOU KNOW, FROM THE STREET OR SOMEONE'S DRIVEWAY? WE DON'T KNOW THAT, UM, YOU KNOW, CERTAINLY WE TALK ABOUT BOTTLE LOCKETS, ANYTHING THAT GOES UP IN THE AIR, ESPECIALLY PALM TREES.

THAT'S WHERE WE SEE A LOT OF OUR TREE FIRES, WHICH ARE A LOT OF THE FIRES THAT WE RESPOND TO.

BUT WE ALSO SEE HOME FIRES, A GARAGE FIRES FROM DISCARDED FIREWORKS.

WE SEE DUMPSTER FIRES, SEE CAR BUYERS FROM, UH, FROM FIREWORKS, UM, YOU KNOW, THAT ARE IN THE STREET.

AND SO IT'S, IT'S HARD TO SAY THAT, YOU KNOW, WE HAVE, YOU KNOW, WE'RE HAVING THIS ISSUE IN THE STREET BECAUSE WE'RE, WE'RE ACTUALLY HAVING ISSUES WITH FIREWORKS IN GENERAL, WHEREVER THEY'RE BEING LAID OFF.

AND I WANTED TO ASK THE, UM, CITY ATTORNEY A QUESTION.

UM, SO THE ATTORNEY, IF WE, IF WE SAY YES, IF WE GO THIS DIRECTION, UM, WE CAN ALWAYS COME BACK AND SAY, HEY, YOU KNOW WHAT? WE REALIZE THAT THE FIREWORKS FOR NEXT YEAR OR THIS YEAR COMING UP, WE REALIZED THAT THERE WAS WAY MORE INCIDENTS HAPPENING AND WE NEED TO KIND OF CONTROL THE SITUATION UP UNTIL THIS POINT.

WE HAVEN'T REALLY HAD MAJOR RISKS OUTSIDE OF THE TRADITIONAL THINGS THAT CHIEF HAVE JUST SPOKEN ABOUT.

BUT IF WE SAID, YES, LET'S MOVE FORWARD WITH THIS.

AS A COUNCIL, WE CAN ALWAYS COME BACK AND SAY, HEY, WE DIDN'T LIKE THAT DECISION.

IF THERE'S AN INJURY SOMEHOW, UM, AND SOMEONE IS HURT OR THEIR PROPERTY IS DAMAGED, THE PERSON WHO LIVED OFF THE FIREWORKS IS VERY LIKELY TO BE SUED AND THE CITY WILL PROBABLY BE DRAGGED INTO THAT LAWSUIT.

SO, UH, I, I DON'T WANT TO PUT MORE CURVES TO BE SUED OR TO HAVE, UH, PUBLIC DOLLARS BECAUSE IT IS EVERY TIME WE'RE SUED, IT'S YOUR TAXPAYER DOLLARS.

I DON'T RECALL ANY NOTICE OF PLANES THAT HAVE COME THROUGH INVOLVING FIREWORKS, NAMING THE CITY SPECIFICALLY PRIOR TO THAT, I'M NOT AWARE OF ANY, BUT THAT DOESN'T, THERE COULD HAVE BEEN STUFF.

I JUST DON'T.

SO CURRENTLY RIGHT NOW, WE'RE HERE AND CURRENTLY RIGHT NOW, THERE'S, UM, THE CONCERN TODAY THAT WE'RE TALKING ABOUT IT, BECAUSE WE'RE TALKING ABOUT IT OUT LOUD AND OPENLY, IT THEN DRAWS THE MIND LIKE, OH, THIS IS A POSSIBLE THING.

AND SO TODAY WE'VE SO, SO I GUESS THAT'S THE BEST WAY TO ASSESS IT FROM 2018 TO NOW, WE HAVEN'T REALLY HAD ANY ISSUES OR ANY WORRIES IN TERMS OF THIS PARTICULAR ISSUE.

WE HAVE NOT RECEIVED ANY LITIGATION OR, OR EVENING CLAIMS THAT ARE RELATING TO THE USE OF FIREWORKS.

SO, SO THEN THAT MEANS THAT, UM, FROM A RISK MANAGEMENT PERSPECTIVE, THE PROFITABILITY OR THE PROBABILITY OF THIS HAPPENING IS PROBABLY VERY, VERY SLIM, UM, TO, TO ACTUALLY IT HAS NOT HAPPENED.

AND SO I THINK OUR LAWS WOULD APPLY TO THE PUBLIC STREETS.

SO IF WE VOTE YES TO THIS, THEN WE BASICALLY, UM, JUST TAKE OUT THE LANGUAGE AND LET THE, LET THEM HANDLE IT.

THE POLICE HANDLE IT, THAT THE HIGHER AUTHORITY HANDLE IT.

WE'VE BOTH KNOWN.

UH, SHE IS THE DIVERSITY EQUITY INCLUSION, UM, UH, LEADER OVER THERE AT CUSD.

I THINK COUNCILWOMAN, I, WE JUST HAD A GOOD TIME WITH THE STUDENTS.

AND I THINK THAT THIS IS THE OPPORTUNITY FOR US TO RECOGNIZE THAT OUR BLACK STUDENT UNIONS OR THE EAST VALLEY HAS BEEN JOINED TOGETHER.

WE FOUND OUT THAT JUST THE EVENT ITSELF, WHAT ABOUT $150,000 HERE IN CHANDLER? AND WE DON'T EVEN KNOW ABOUT THE REST OF IT BECAUSE THEY WENT TO THE GRAND CANYON.

THEY HAD A CHANCE TO SPEND SOME TIME DOWNTOWN AND SPENDING SOME MONEY HERE AT DC AND IN THE SQUARE AND DOING QUITE A BIT ALL OVER.

WE HAD A CHANCE TO GO TO THE MUSEUM.

SO THERE WAS A LOT OF THINGS, BUT WE PARTNERED WITH THE MUSEUM ACTUALLY, AND HAD DISPLAYED SO THAT THEY WILL BE ABLE TO SEE WHAT CHANDLER WAS ALL ABOUT.

SO WE WERE A GREAT HOST AND THEY ALL VERY HAPPY.
