BEFORE THIS REGULAR MEETING, WE HAD A STUDY SESSION REVIEWING THE ITEMS ITEMS ONE THROUGH SEVEN.

WE DO HAVE A COUPLE OF STIPULATIONS THAT WERE ADDED ON ONE ON ITEM.

NUMBER TWO, IF STAFF WOULD LEAVE, READ THAT INTO THE RECORD AND WE ALSO HAVE A CHANGE ON ITEM NUMBER FIVE, UH, OF A CONTINUANCE ON THAT.

AND THEN ALSO I THINK ITEM NUMBER SIX, WE WERE TALKING ABOUT ON THE BONGOS AND THINGS AS WELL KNOW WHERE WE CAME OFF OF THAT.

SO, CHRISTINE, IF YOU WANT TO READ THE, THAT STIPULATION TO THE RECORD WOULD BE GREAT TO, YES, THE ADDED STIPULATION NUMBER EIGHT FOR THE PRELIMINARY DEVELOPMENT PLAN READS THE APPLICANT SHALL WORK WITH STAFF TO REVISE THE SIDE AND REAR ELEVATIONS TO REDUCE THE AMOUNT OF BLANK FACADE AREA.

I KNOW THERE WAS SOME CONVERSATIONS ABOUT BONGOS AND THINGS LIKE THAT.

UM, THAT WAS A CONCERN, I MEAN, AND, UM, KEVIN REMEMBERS THIS CASE FROM BACK IN 2012, SO I'M JUST WANT TO MAKE SURE THAT WE'RE OKAY.

I DON'T KNOW IF WE NEED TO LIMIT THAT OR ADD THAT AS ADDITIONAL STIPULATION.

CAUSE I KNOW IT'S TALKED ABOUT ALLOWING THAT THAT'S ONE OF THE, THAT'S ONE OF THE USES WE CAN JUST IT'S BONGOS THAT THE BIGGEST CONCERN OF OVER BOX DRUMS OR, WELL, JUST, YOU KNOW, WHEN YOU START TALKING DRUMS AND YOU START TALKING THAT IT'S A DIFFERENT KIND OF LEVEL OF NOISE AND STUFF, SO THAT'S ALL, SO YEAH.

AND IT WAS, WE WERE TRYING TO FIND LIKE A MIDDLE GROUND, UH, CAUSE OF COURSE THERE'S SOME DRUM THAT MAYBE SEEMED REASONABLE.

WE THOUGHT BONGOS WAS MAYBE ONE OF THEM, BUT WE COULD NOT INCLUDE BONGOS GOING FORWARD TO CITY COUNCIL, ACCORDING TO CITY COUNCIL, BUT THE COUNCIL I'M OKAY WITH THAT.

SO DAVID, IF I MAY, IT MAY BE EASIER TO REGULATE IF WE SAY NO PERCUSSIONS PERIOD.

SO NO BONGOS, NO BOX JOHNS.

IT JUST MAY, MAYBE IT WOULD MAKE IT EASIER FOR STAFF TO, OKAY.

ANY COMMENTS FROM COMMISSION? OH, THROUGH THE CHAIR? UM, YEAH, I'M FAMILIAR WITH THE OWNER AS WELL.

AND I THINK, UH, IT SOUNDS LIKE THEY HAVE, THEY HAD AN ISSUE IN THE PAST, BUT UH, YOU KNOW, I, I'M NOT REALLY ON BOARD TO TAKE OUT THE BONGOS CAUSE I THINK THAT THE, THE OWNER OF THIS PROPERTY HAS BEEN THERE FOR YEARS AND YEARS AND THAT THEY'D REACT, YOU KNOW, IF, IF THERE IS ISSUES, SO TO, TO TAKE, I MEAN, I THINK SOMEONE SAID MOROCCO'S AS WELL AND THEN A BOX DRUM.

SO I THINK WE'RE REALLY GETTING, I MEAN, PERCUSSIONS WHEN YOU SPEAK OF PERCUSSIONS, UM, I THINK THERE'S DIFFERENT WAYS TO MITIGATE SOME OF THE SOUNDS.

AND SO, UM, I WOULD, I WOULD LEAVE IT IN AND I THINK, I THINK WE, THE NEIGHBOR WILL REACT OR THE OWNER WILL REACT IF THERE IS ISSUES.

UM, SO THAT'S, THAT'S MY STANCE JUST WITH THE HISTORY AND HOW LONG THEY'VE BEEN THERE WHILE THERE HAS BEEN THERE.

HASN'T BEEN AN UNDERSTANDING ON THAT AND I KNOW THE OWNERS AS WELL, AND THEY'VE DONE A GREAT JOB.

I'M JUST TRYING TO PREVENT STUFF FROM HAPPENING.

SO WE DON'T HAVE A SITUATION WHERE WE HAD IN 2012, CAUSE THEY HAVEN'T DONE ENTERTAINMENT SINCE 15, THEY GOT RID OF THE ENTERTAINMENT USE.

SO I'M JUST TRYING TO LOOK, I'M LOOKING FOR BEING PROHIBITED FOR, UM, HELP AHEAD OF TIME VERSUS WORRYING ABOUT IT ON THE BACK END.

UH, THAT THAT'S WHERE I'M, YOU KNOW, AND MAYBE

IT'S JUST WORKING WITH THE APPLICANT TO UNDERSTAND THAT TOO.

I MEAN, I'M, I HAVE NO PROBLEM CAUSE THEY ARE GOOD OWNERS, DAVID, SO MAYBE IT'S WORKING WITH MAKING SURE THE APPLICANT UNDERSTANDS IT, THAT IT'S A TWO YEAR TIME STEP, BUT I KNOW WE CAN'T DO MUCH IN TWO YEARS.

I JUST KNOW THE RULES.
